FKE Direct Employers to Maintain Enhanced NSSF Deductions Despite Court Ruling

The Federation of Kenya Employers (FKE) advises its members to continue deducting and remitting National Social Security Fund (NSSF) contributions at the enhanced rates under the NSSF Act 2013, despite a Court of Appeal ruling that dismissed NSSF's application to suspend a judgment declaring the Act unconstitutional. FKE argues that reverting to the old rates would create legal and administrative challenges for employers and employees. The Court of Appeal noted that NSSF failed to demonstrate that denying the stay would cause irreparable harm to the pension sector. FKE urges the Court of Appeal to clarify the matter.
