High Court Rejects Petition to Liquidate KUSCCO

The Nairobi High Court dismissed a petition to liquidate the Kenya Union of Savings and Credit Co-operatives (KUSCCO) over an alleged unpaid debt of approximately Ksh108.85 million. Justice Rhoda Rutto ruled that the petition was filed under the wrong legal framework because KUSCCO is registered as a cooperative society, not a company under the Companies Act. The court also stated that KUSCCO's status as a body corporate does not automatically make it subject to the Insolvency Act, and its dissolution must be ordered by the Cooperative Development Commissioner.
