Ministries, agencies to get greater say in PPP deals

The Kenyan Parliament is considering amendments to the Public Private Partnerships (PPP) Act that would give ministries, state departments, and parastatals greater authority in selecting firms for PPP projects. Currently, the National Treasury's PPP Directorate reviews and approves tender evaluation reports, but this role would be removed under the proposed changes. Contracting authorities would be able to pick winning bidders without directorate approval, and the directorate's approval would no longer be required for project and financial risk assessment reports. The amendments also allow more direct procurement by easing the requirement that works or services be available from a limited number of private parties.
