Court of Appeal Upholds KSh4.7 Million Award to Employee Fired While on Sick Leave

The Court of Appeal of Kenya upheld an award of over KSh4.7 million to former salesman Hudson Kidaha Kisigwa, who was dismissed in May 2010 while on sick leave and hospitalized. Kisigwa learned of his dismissal through a newspaper notice and was not given a hearing. The employer failed to provide a valid reason or follow legal procedure. The court also rejected the company's appeal regarding unpaid commissions.
