Lindsay Clancy in court to drop child murder charges after mistrial

Lindsay Clancy, accused of killing her three young children at their home in Duxbury, Massachusetts, appeared in court on Monday seeking to have the first-degree murder charges dismissed. Her lawyer, Martin G. Weinberg, argued that a retrial would violate her constitutional rights and said Judge William Sullivan should have investigated further after the jury foreperson reported that a juror was not following the rules. The trial ended in a mistrial in August after jurors failed to reach a verdict. Prosecutors intend to retry Clancy if the case proceeds, but have not decided whether to pursue the same charges.
