High Court Declares CJ Maraga Advisory on Parliament Dissolution Unconstitutional

The High Court of Kenya ruled unconstitutional an advisory by former Chief Justice David Maraga recommending the dissolution of the 12th Parliament in 2020 for failing to implement the two-thirds gender rule. The court found the advisory premature and not meeting constitutional requirements, specifically the formal transmission of court orders to Parliament and the Attorney General. The ruling was delivered by a five-judge bench. Currently, women hold 23% of seats in the National Assembly and 31.3% in the Senate.
