The Makkah Mosque Incident: A Call to Reflect on Justice, Repentance and Ta’zir

Haroon-Ishola Balogun says Bangladeshi migrant workers Nazrul Islam Abdul Basir and Siti Akhtar were not newlyweds punished for a kiss, but were convicted of an explicit sexual act inside a mosque in the Makkah region. Balogun urges Muslim institutions and jurists to examine procedural safeguards, including consular access and prior notification, as well as the role of repentance and rehabilitation. He also questions the proportionality of discretionary punishment and argues that ta’zir should account for mercy and the possibility of reform.
